8 Mondays, 9:30 - 11:30 a.m. March 23 - May 18, no class April 20
[NOTE: This class starts earlier than other spring courses.]
Using a basic text, film, cases and stories, this course addresses the major themes, issues and
techniques of environmental law and its ethical and policy objectives. The instructor recommends the book, Environmental Law and Policy by James Salzman and Barton H. Thompson, Jr., 4th edition (Foundation Press). The book is a paperback and also available in a Kindle edition, and is an up-to-date survey that can be a starting point for further research regardless of your specific interests and background.
The course will survey the origins and development of environmental law in the context of its scientific, ethical and practical goals and methods. Current developments in Maine, the nation and around the world will be open for discussion. For those interested in greater depth, power point slides and notes in Word or PDF format will be made available in class or on-line. The course will be accessible to all who are interested and concerned about this important subject. Videos and web links will supplement lectures, and discussion of questions raised in each unit will be a focus of each class.
The first class will provide an overview of the course, and discuss the two main strands of environmental law: natural resources and pollution control, and basic themes such as scientific uncertainty, market failures, public goods, rights, sustainability, cost-benefit analysis and environmental justice. The regulatory process, constitutional issues & the role of citizen suits and NEPA's environmental impact statement process will also be explained.
Instructor Bruce L. Rockwood is Professor Emeritus of Legal Studies at Bloomsburg University, PA. His B.A. (History-Honors) is from Swarthmore College, his J.D. from the University of Chicago Law School. He is an associate of the Environmental Law Institute, and a member of the Energy and Natural Resources Section of the American Bar Association, the American Society of International Law, and the Academy of Legal Studies in Business.
